Buying or selling a second-hand car in Tenerife is a common rite of passage for many expats. While finding the right vehicle can be exciting, the administrative process, known as the "Traspaso," can be confusing. This guide breaks down the essential steps for both buyers and sellers to ensure a smooth and legally sound transfer of ownership.

What is a Traspaso and Why is it Essential?

A Traspaso is the official process of transferring a vehicle's legal ownership from the seller to the buyer. It is handled by Spain's traffic authority, the DGT (Dirección General de Tráfico). Completing the Traspaso is not optional; it is a legal requirement. Failure to do so can result in fines, issues with insurance, and legal responsibility for any infractions committed by the new driver.

The Key Documents

Before you begin, you need to have the car's two most important documents in hand:

  • Permiso de Circulación: The vehicle's registration document (logbook). This shows the current owner's details and the vehicle's specifications.
  • Ficha Técnica: The technical specifications sheet. This also contains the vehicle's ITV (MOT) history.

The vehicle must have a valid ITV (Inspección Técnica de Vehículos) roadworthiness certificate for the transfer to be possible.

For the Seller: Your Responsibilities

As the seller, your main job is to provide the correct documentation and sign the sales contract. You must ensure:

  • All road tax (IVTM) is paid up to date.
  • There are no outstanding fines or embargoes on the vehicle.
  • You have the original Permiso de Circulación and Ficha Técnica.
  • You sign the sales contract (`contrato de compraventa`) with the buyer.

It is wise to retain a copy of the buyer's ID and the signed contract until you are certain the transfer has been completed.

For the Buyer: Your Responsibilities

As the buyer, you are responsible for completing the final steps of the Traspaso. This typically must be done within 30 days of the sale.

  1. Sign the Sales Contract: A simple contract stating the vehicle details, price, date, and details of both parties is essential.
  2. Pay the Transfer Tax: You must pay a transfer tax (Impuesto de Transmisiones Patrimoniales - ITP) at the Hacienda (tax office).
  3. Book a DGT Appointment: You need a `Cita Previa` (appointment) at the DGT to present all the paperwork.
  4. Submit Documents: At the DGT, you will submit the application form, proof of tax payment, the contract, the car's documents, and copies of everyone's ID.
